These Terms of Service ("Terms") are a binding agreement between you and Backsie Inc. ("Backsie," "we," "us," or "our"). They govern your access to Backsie's mobile and web applications, websites, community and sharing features, communications, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into these Terms. By using Backsie, you represent that you meet those requirements. The Service is not directed to children or teenagers under 18.
Backsie is a self-reflection and clarity product. Available features may include AI-assisted conversations, conversation memory, Mental Checkpoints, Insight Cards, patterns and suggested next steps, screenshot text extraction, speech-to-text, read-aloud, PDF export, reminders, community reactions, and optional anonymous or public sharing.
Features may differ by platform, environment, account, or release and may change during beta. We may add, limit, suspend, or discontinue features. Any trial, free access, paid plan, renewal term, price, or feature limit will be presented to you before it applies or before you authorize a purchase. Store purchases, if offered, are also subject to the applicable Apple or Google terms.
Backsie is not therapy or an emergency service. It does not provide medical or mental-health advice, diagnosis, treatment, crisis monitoring, or professional care. No therapist, clinician, or human operator is continuously reviewing your conversations.
If you believe you may be in immediate danger or have a medical emergency, contact local emergency services or an appropriate qualified professional. Do not wait for Backsie to detect or respond to an emergency.
You agree to provide accurate information, protect your sign-in credentials and device, and promptly tell us about suspected unauthorized use. You are responsible for activity through your account unless applicable law provides otherwise. You may not transfer or sell your account.
Authentication may be provided through Amazon Cognito, Sign in with Apple, or Google. Those third-party sign-in services are also governed by their own terms.
Backsie uses automated systems to generate conversations and reflections, retrieve relevant prior context, classify possible safety concerns, extract text from screenshots, and generate audio. AI output may be incorrect, incomplete, overly certain, delayed, or inappropriate. It may not understand your circumstances or detect indirect or urgent risk.
"Your Content" includes messages, screenshots, profile information, feedback, shared cards, and other material you submit. As between you and Backsie, you retain your rights in Your Content. You give Backsie a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, format, analyze, and otherwise process Your Content only as reasonably necessary to provide, secure, support, moderate, and improve the Service and comply with law.
You represent that you have the rights needed to submit Your Content and that doing so does not violate law or another person's rights. Avoid submitting confidential information about other people unless you have the right to do so.
Conversations, Mental Checkpoints, and Insight Cards are private by default. A card becomes available to other people only when you take an explicit sharing or publishing action.
If you publish anonymously, your profile identity is not displayed publicly, but the post is not anonymous to Backsie while your account is active. We retain an internal association for ownership, moderation, security, and deletion. Public share links can be opened and reshared by anyone who receives them. We cannot control copies made outside the Service.
When deleting your account, you may be offered a choice to remove already-published community cards or leave de-identified published copies. If you retain them, their account and private-source links are removed. Details are in our Privacy Policy.
You may not use the Service to:
We may review reports, restrict distribution, remove content, preserve evidence, or suspend accounts to enforce these rules. Moderation is not guaranteed to identify every violation. If you encounter concerning community content, use the reporting controls or contact us.
The Service—including its software, design, branding, interfaces, and Backsie-created materials—is owned by Backsie or its licensors and protected by law. Subject to these Terms, Backsie gives you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose. These Terms do not grant you ownership of Backsie technology or trademarks.
If you send feedback, ideas, or suggestions, you allow Backsie to use them without restriction or compensation. This does not transfer ownership of your private conversations or other personal content.
Our Privacy Policy explains how we handle personal information. Our Consumer Health Data Privacy Policy provides additional disclosures and rights for information that may reveal physical or mental health, wellbeing, or related inferences.
The Service depends on third parties for hosting, authentication, AI processing, speech services, communications, distribution, and other functionality. Their products and external links are governed by their own terms. Backsie is not responsible for independent third-party services, but our use of service providers is described in our privacy notices.
You may stop using Backsie at any time and may initiate account deletion from in-app settings. We may limit, suspend, or terminate access when we reasonably believe you violated these Terms, created risk for another person or the Service, failed to pay an authorized charge, or when required by law. Where appropriate, we will provide notice and an opportunity to appeal by contacting us.
Sections that by their nature should survive termination—including content licenses needed for retained public posts, intellectual property, disclaimers, liability limits, and dispute terms—will survive.
To the fullest extent permitted by law, the Service is provided "as is" and "as available." Backsie disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing. We do not warrant that the Service or AI output will be accurate, suitable, uninterrupted, secure, or error-free, or that content will never be lost. Some jurisdictions do not allow certain disclaimers, so some of these terms may not apply to you.
To the fullest extent permitted by law, Backsie and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, exemplary, consequential, or punitive damages; loss of profits, goodwill, use, or data; or harm arising from reliance on AI output, third-party services, community content, or unauthorized sharing. Backsie's total liability for claims relating to the Service will not exceed the greater of the amount you paid Backsie for the Service during the 12 months before the event giving rise to the claim or US $100.
These limits do not apply where prohibited by law or to liability that cannot lawfully be limited.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Nothing in these Terms deprives you of mandatory consumer protections that apply where you live.
We may update the Service and these Terms. For material changes, we will update the effective date and provide additional notice when required. Changes apply prospectively. If you do not agree to updated Terms, stop using the Service and delete your account.
If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Backsie may assign them in connection with a reorganization, financing, merger, acquisition, or sale of assets. These Terms and the incorporated privacy notices are the entire agreement about the Service unless separate written terms apply.
